Advanced Legal Writing & Editing
Our most popular seminar focuses on analytical and persuasive writing, with most examples coming from actual memos and briefs. The day concentrates on the five major skills that good legal writers must develop to:
- Frame issues that get the judge’s attention and state the case in 90 seconds
- Achieve a lean style that makes their prose stand out from most legal writing
- Smooth the transitions between sentences and paragraphs
- Quote authority most effectively
- Get their projects down on paper most efficiently
To practice what they’re learning, participants work on several short but challenging exercises throughout the day.
The Winning Oral Argument
The perfect companion to The Winning Brief, this seminar concentrates on the nuts-and-bolts of oral advocacy.
The seminar emphasizes the techniques used by first-rate judicial writers. Participants learn:
- How to prepare yourself for effective public speaking
- How to prepare your argument before you get into court
- How to present your case once you’re in court
- Why questioning from judges gives you your best opportunity for persuading the court
- How to use rebuttal time most effectively
The textbook draws on “enduring principles” of advocacy from Aristotle’s Rhetoric to contemporary courtroom giants. It relies extensively on Garner’s one-on-one interviews with some of the finest judicial minds of our generation about what does and does not work for the advocates who come before them.
Advanced Transactional Drafting
Transactional lawyers praise this course for helping them with everything from licensing agreements to acquisitions to wills and trusts.
The emphasis is on the practicalities of contractdrafting that most law schools fail to teach. You'll learn how to prepare legal documents that don't merely stand up in court but preclude litigation in the first place because of their unmistakable meaning.
Bryan Garner is the drafter entrusted by many Fortune 500 companies to revise their most important contracts. The United States Judicial Conference selected him to redraft federal rules, and the American Law Institute had him revise its bylaws and council rules.
Even the most experienced drafters consistently say that Garner's methods have improved their contracts more than any other educational experience they have had.
As usual, Garner provides eye-opening examples and lots of good forms.
